This Children’s Privacy Notice is provided to education institutions that contract with Avant Assessment (Avant) for products and services that they intend to use with students under age 13. We provide this notice to our education institution customers, and we encourage them to share it with parents. We post it here as well so that it is easily accessible to our education institution customers and their parent communities.

When our educational institution customers decide to use Avant Assessment products and services with their students under the age of 13, Avant relies on an authorized individual at the educational institutions to consent to our collection of personal information from these students on behalf of their parents before we collect that information. In providing its consent to us, the educational institution represents that it is authorized to act in lieu of parents in doing so, or that it has obtained authorization from all such parents (to the extent required by applicable law) for us to collect personal information from these students in connection with their use of our products.
We provide this notice in order to help ensure that the consent provided by the educational institution is done with an understanding of what personal information we intend to use from children under age 13 and how we intend to use it.
Personal Information We Intend to Collect
Avant will generally collect the following personal information from students, including children under the Avant will generally collect the following personal information from students, including children under the age of 13:
- First and last name, test taker ID, written and spoken responses to test questions, and testing results.
- For certain tests used by education institutions to place students in the appropriate level language class, students are also asked to provide the following: number of years the language has been studied or spoken, other tests taken in the language, grades of formal study, and household language proficiency.
- When authorized by their education institution in relation to application to the Global Seal of Biliteracy or an Avant Digital Badge, students may also be asked to provide an email address. The email address is used to send the seal or badge when awarded.
- Avant collects district name, teacher name, state, school name, other staff names, testing group name, and language from education institution customers which Avant associates with test takers to facilitate delivery of the services.
Avant may also use cookies to automatically collect certain other information, including usage information, browser and device information, log data, IP address, JSON web token, and approximate geolocation. This information is used to provide our services and to provide aggregated and deidentified usage metrics to schools and school districts.
How We Use and Share Student Personal Information
Avant shall only collect and use the personal information described above as necessary to provide the Services, including for support purposes and to qualify and maintain the quality of our graders and our Services.
If necessary to provide the services, we may share certain test taker personal information with companies that assist us in providing the services. This includes companies that provide cloud services for storage of the information, security services to help maintain confidentiality of the information, analytics companies that help us understand how our services are used and to troubleshoot issues, and if you purchase certain optional services, badging and credentialing providers. The authorized individual at the educational institution may request, on their own behalf or on behalf of the respective test taker’s parent (1) to review personal information that is collected from their test takers under the age of 13; (2) to request deletion of any or all such personal information; and (3) to instruct Avant to cease further use or collection of personal information from any or all such test takers. Avant will otherwise delete personal information that is collected from test takers under the age of 13 within 90 days of termination of the contract with the education institution unless it is legally necessary for us to retain it for a longer period of time.
